Terms of Use
PARTIES AND PURPOSE
This agreement is made for the purpose of renting the "VILLA/HOUSE" for a pre-determined period of start and end dates between the renter of the "VILLA/HOUSE" (hereinafter referred to as "CUSTOMER") and the lessor of the "VILLA/HOUSE" (hereinafter referred to as "MoonSA Boutique Villas"). The customer and those accompanying them who make a reservation for any of our "villas/houses" advertised on the "moonsa.com.tr" website via our website, by telephone, or via email are deemed to have accepted the following terms in advance. Any violation of any of the following terms gives "MoonSA Boutique Villas" the right to unilaterally cancel the reservation, request the customer to leave the villa/house, not refund the down payment or rental fee received, and claim the entirety of unpaid rental fees.
RESERVATION AND PAYMENT
CHECK-IN AND CHECK-OUT TIMES FOR VILLA/HOUSE
On the check-in day, check-in to the villa/house is at 14:00 at the earliest and 23:00 at the latest. The customer cannot check-in to the villa/house outside the specified hours; in case of arrival after the specified latest check-in time, check-in to the villa/house can be made the next day at the start of working hours (10:00) of MoonSA Boutique Villas. MoonSA Boutique Villas cannot be held responsible under any circumstances for problems arising from the customer's inability to check-in when arriving before or after the specified hours, night accommodation, inability to find accommodation, etc. The customer must find their own place to spend the night and pay for the accommodation fee themselves. MoonSA Boutique Villas cannot be held responsible for such situations. At the end of the reservation, the check-out time from the villa/house is 11:00 AM at the latest. The customer is solely and directly responsible for all negative situations such as problems, damages, and grievances arising from the customer not vacating or vacating late the villa/house at 11:00 AM, and is obliged to cover all kinds of material damages of MoonSA Boutique Villas that may arise from these situations. We strongly remind you that travel plans should be made according to these hours so that neither party suffers any grievance. If an early check-out is requested, MoonSA Boutique Villas must be notified 24 hours in advance. In case the customer departs from the villa/house without a villa/house inspection due to high occupancy, the damage deposit will be sent to a bank account provided by the customer, and transfer fees will be paid out of the damage deposit. If the customer leaves the villa/house early of their own accord, no refund will be made to the customer for the accommodation fee. Check-in/check-out times of villas and houses may vary; therefore, the times specified on the detail page of the relevant villa/house shall be taken as basis.
VILLA/HOUSE CAPACITY
Guests exceeding the capacity specified on our website or exceeding the number of people specified during the reservation are strictly not accepted to our villas/houses. If the customer wishes to make a change in the number of people after the reservation is confirmed, they shall apply to MoonSA Boutique Villas, and if MoonSA Boutique Villas deems it appropriate according to the capacity of the villa/house, this change may be approved. MoonSA Boutique Villas may request additional fees from the customer. After check-in to the villa/house, guests other than those specified in the reservation list are strictly not accepted to the villa/house. In cases where the contrary is determined, MoonSA Boutique Villas has the right to request the guests to leave the villa/house, cancel the reservation completely, or request the villa/house to be completely vacated without waiting for the end of the rental period, and demand the entire fee as well as extra fees. Actions are taken in accordance with the customer's declaration during the rental process of the villa/house, and the customer accepts that the information provided is correct and complete, and accepts all responsibilities that may arise in this regard.
VILLA/HOUSE CLEANING/MAINTENANCE AND EXTRA EXPENSES
Entry cleaning is included in daily, weekly, and monthly villa/house rental prices. For stays of 2 (two) weeks or more, weekly cleaning and change of towels/sheets etc. are included in the prices. Any other cleaning and towel/sheet change requested outside of this is subject to a fee. Pool and garden maintenance is carried out early every morning, and any technical issues experienced in the villa/house during the rental period will be resolved by MoonSA Boutique Villas. In order to carry out the periodic maintenance of the pool, garden, and other fixtures of all villas/houses, authorized personnel must enter the garden or interior of the villa/house. To ensure these services are carried out without interruption, the customer must allow authorized personnel to enter the villa/house when necessary. Unless specified otherwise on the villa/house details page of our website, electricity, water, bottled gas, pool lighting, internet connection, and A/C usage are included in the prices. Pool lighting, A/C, and internet may not be available as standard in every villa/house; therefore, it is recommended to read the features of the villa/house you rented carefully on our villa/house features page.
PETS / SMOKING
Unless stated otherwise, small breed pets are accepted to our villas/houses for an additional fee.
Smoking is not permitted inside our villas/houses.
PRICES
The villa/house rental rates specified on our website are valid for the selected date range.
CANCELLATION TERMS AND REFUND CONDITIONS
- 24-Hour Unconditional Refund: For cancellations made within the first 24 hours following reservation confirmation, the entire down payment or accommodation fee paid is refunded unconditionally. (Applies to reservations with at least 30 days remaining to the check-in date.)
- Flexible Date Change: You may request a date change up to at least 14 days before your reservation check-in date. Change requests are processed based on the availability of our properties. If there is an increase/difference in the nightly rental rates for the new period of the date change, the resulting price difference will be charged to the customer as an additional fee. Date changes are not possible for reservations with less than 14 days remaining to the check-in date.
- Standard Bank Transfer/EFT Cancellations: If the 24 hours following the reservation confirmation is exceeded and for cancellations made up to 30 days before the check-in date of the villa/house, the entire total accommodation fee is applied as a deduction (no refund).
- Sanal POS Cancellations: For payments made via virtual POS (credit card), there is no cancellation or refund option after the first 24 hours following the reservation confirmation, and the entire total accommodation fee is applied as a deduction.
- No-Show Situation: In cases where the reservation is not cancelled in time, the check-in to the villa/house is not made, or the stay is not realized at all, the total paid reservation amount will not be refunded to the customer.
- Cancellation by the Management: In the event that the reservation is cancelled by MoonSA Boutique Villas for any reason, the situation will be notified to the customer as soon as possible. An equivalent villa/house will be proposed if available, and if the customer does not approve it, the money received will be refunded to the customer without any deduction.
- Limits of Liability: MoonSA Boutique Villas cannot be held responsible for the non-use of the villa/house in cases arising from the customer's fault or termination of the contract without proper written notice. The entire contract fee becomes due on the check-in date.
SWIMMING POOLS
The swimming pool temperatures of our villas/houses vary according to weather conditions and seasonal temperatures; MoonSA Boutique Villas cannot be held responsible under any circumstances if the customer renting the villa/house cannot use the pool due to the pool being cold. The customer who will rent the villa/house can get information to learn the weather conditions on the date of rental from the website of the Turkish State Meteorological Service or by calling them directly.
OUR RESPONSIBILITIES AND GUARANTEE
MoonSA Boutique Villas is responsible for delivering the villa/house to the customer at the designated date and time, clean and ready for use. Upon check-in to the villa/house, if there are any broken or malfunctioning items or problems, the customer must notify MoonSA Boutique Villas immediately and request these issues to be resolved. MoonSA Boutique Villas will assist in resolving this problem, if possible, within 48 hours at the latest. MoonSA Boutique Villas is not directly responsible for resolving the technical malfunction, but assists in its resolution. MoonSA Boutique Villas cannot be held responsible for issues that are not reported in a timely manner.
RESPONSIBILITIES OF CLIENTS
Clients are obliged to use the villa/house, pool, garden furniture, all electrical and electronic appliances, and other furniture delivered to them in working and robust condition, cleanly. Clients must leave all kitchen utensils delivered clean to them in the same clean state. In cases where the villa is left excessively dirty beyond reasonable limits, MoonSA Boutique Villas will deduct a cleaning fee from the damage deposit.
In case of any damage in the villa/house, clients are obliged to notify MoonSA Boutique Villas. The cost of any damage caused to the villa/house or any lost items during the stay will be deducted from the damage deposit, if collected; in case of damage exceeding the damage deposit, cash payment will be requested from the client.
In addition, the client and those accompanying them must pay attention to comply with social and moral rules, not to make noise to disturb the environment, not to listen to loud music, and not to engage in behaviors prohibited by the laws of our country and constituting a crime. If a complaint is received by MoonSA Boutique Villas about the client and those accompanying them for such reasons, MoonSA Boutique Villas has the right to request the client to vacate the villa/house before the reservation period expires.
FORCE MAJEURE
In cases falling within the scope of force majeure, MoonSA Boutique Villas may unilaterally terminate this agreement without incurring any legal liability. War, threat of war, riots, strikes, natural disasters, fires, terrorist activities, epidemics in the region or country, technical problems that may occur in transport, infrastructure and superstructure works carried out by municipalities or public institutions that MoonSA Boutique Villas cannot prevent, prohibitions by government authorities in the region, and all events that are unpredictable and develop outside our control will be evaluated within the scope of force majeure.
COMPLAINTS
Clients shall report their complaints during their stay in the villa/house to MoonSA Boutique Villas. The subject of the complaint will be investigated by MoonSA Boutique Villas staff, and necessary measures will be taken immediately. MoonSA Boutique Villas cannot be held responsible under any circumstances for complaints that are not reported during the stay but are made after the accommodation ends and the client leaves the villa/house.
SECURITY AND PRIVACY POLICY
MoonSA Boutique Villas will not disclose personal information to any company or third parties except for the cases defined in this Privacy Policy and User Agreement. MoonSA Boutique Villas never sells the personal information of visitors, registered users, and partners to third parties. Personal information refers to all kinds of information intended to define the user, such as name-surname, address, telephone number, and email address. MoonSA Boutique Villas can use personal information within its own structure to determine user profiles and conduct statistical studies, and may share it with third parties solely for the purpose of carrying out these studies. MoonSA Boutique Villas undertakes to keep personal information strictly private and confidential, to deem it a confidentiality obligation, to take all necessary measures and show due diligence to ensure and maintain confidentiality, and to prevent all or any part of confidential information from entering the public domain, unauthorized use, or disclosure to a third party. Despite MoonSA Boutique Villas taking the necessary information security measures, in the event that confidential information is damaged or falls into the hands of third parties as a result of attacks on the "moonsa.com.tr" website and the system, MoonSA Boutique Villas shall not have any liability. The moonsa.com.tr website may provide links to other websites. moonsa.com.tr bears no responsibility for the privacy practices and contents of websites accessed via links. moonsa.com.tr identifies and uses the IP addresses of users when necessary. IP addresses can also be used to define users generally and to collect comprehensive demographic information.
OTHER IMPORTANT INFORMATION
- 1) MoonSA Boutique Villas cannot be held responsible under any circumstances for situations that MoonSA Boutique Villas cannot prevent, such as the roads leading to the villa/house being damaged, uphill, unpaved, wet ground, etc.
- 2) MoonSA Boutique Villas cannot be held responsible under any circumstances for all kinds of negative events, such as accidents, that may occur during transport to the villa/house.
- 3) In the event that different materials used in the construction of some villas (cedar wood, pine wood, some plastic products, all kinds of plants in the garden or inside the villa, etc.) disturb the customer health-wise, MoonSA Boutique Villas cannot be held responsible under any circumstances.
- 4) The customer's transport to the villa/house is their own responsibility. MoonSA Boutique Villas cannot be held responsible under any circumstances.
- 5) The customer may obtain taxicabs, transfer vehicles, or rental cars from third parties. MoonSA Boutique Villas does not interfere with the transfer or taxi services rented or to be rented from third parties. These operations are the customer's own responsibility.
- 6) MoonSA Boutique Villas cannot be held responsible for any damage to your private or rented vehicle during transport to the villa/house.
- 7) MoonSA Boutique Villas cannot be held responsible for accidents such as drowning or falling that may occur in the pool located at the villa/house.
- 8) MoonSA Boutique Villas cannot be held responsible under any circumstances for situations such as cell phone signals not being received at all, low reception, or internet not working on mobile phones in the villas/houses or on the road. You can call your GSM operator to get detailed information about the GSM signal status in the region you are going to.
- 9) MoonSA Boutique Villas cannot be held responsible for all accidents and events caused by the customer in the villa/house, including fire, electrical leakage, gas leakage and resulting deaths and accidents, telephone and internet outages caused by the internet provider (Türk Telekom etc.), power outages caused by the Electricity Company, and water outages caused by the Water Company.
- 10) The Villa/house specified on our website is exactly the same, and claims that it is not as it appears on the site, that it looks better on the site, that it is larger or smaller on the site, etc. can never be accepted, and MoonSA Boutique Villas cannot be held responsible for them.
- 11) MoonSA Boutique Villas cannot be held responsible for all kinds of negative situations that may arise from positive or negative natural events/conditions and positive or negative weather conditions.
- 12) MoonSA Boutique Villas cannot be held responsible for incidents such as bee, scorpion, insect, snake bites, or cat and dog bites affecting the customer.
- 13) MoonSA Boutique Villas cannot be held responsible under any circumstances for any illness, chlorine allergy, or chemical allergy that may occur from water coming from the swimming pool or shower of the villa/house. We recommend that people with allergic reaction sensitivities do not enter the pool.
- 14) In cases of funeral, death, war, health problems, accidents, or cancellation of leave of public or private company personnel, all rental terms apply literally, and cancellation is absolutely out of the question.
DISPUTES
In case of any disputes that may arise regarding issues within the scope of this agreement, Sapanca Enforcement Offices and Courts are authorized.
Clients making a reservation for any of our Villas/Houses are deemed to have accepted all of the above terms. Any violation of any of these terms gives "MoonSA Boutique Villas" the right to unilaterally cancel reservations, make no refunds, and demand the entirety of the fee.
